Unless otherwise stated in the wording or the context, the following expressions have the following meaning assigned to them:

We / Discover Airlines
denotes EW Discover GmbH.

You
denotes all persons who are passengers (see also the definition of "passenger").

Travel class
denotes Economy Class, Premium Economy Class and/or Business Class, respectively.

Booking
includes all information about the planned carriage.

Coupon
is the part of the ticket that entitles the holder to carriage on a single segment.

Passenger
denotes any person who is being transported or is set to be transported with our consent on an aircraft based on having a ticket.

Ticket
electronically recorded, numbered confirmation of a paid flight service, as evidenced by a ticket receipt (passenger receipt). "Air ticket" and "ticket" are used interchangeably hereinafter.

Stopover
is a break in the journey at the request of the passenger at a location between the place of departure and the destination, which we have agreed to in advance.

Baggage receipt
is the part of the ticket that relates to the transportation of your checked baggage.

Air freight carrier
is any air freight carrier that transports the passenger and/or their baggage on the basis of a ticket whose airline code appears on the ticket.

Check-in deadline
is the time specified by us or the respective air freight carrier by which you must have completed your check-in formalities and must be in possession of your boarding pass.

Damage
includes death, bodily injury, damage caused by delay, loss or damage of any kind arising from or in connection with the carriage or other services provided by the air freight carrier.

SDRs
are the special drawing rights according to the definition of the International Monetary Fund.

Days
are full calendar days, including Sundays and public holidays; in the case of notifications, the dispatch date of the notification is not included; when determining the validity period, the day on the ticket or the day of departure is not included.

General information
2.1. These terms and conditions of carriage apply to transportation identified by the airline code "4Y" on the ticket.

Code share
2.2. We have entered into agreements known as “code share” with other airlines. This means that even if Discover Airlines (4Y) is entered as the air freight carrier on the ticket, transportation may be carried out by another air freight carrier. In the event of a code share flight, Discover Airlines will notify you at the time of booking which air freight carrier will operate the flight.

These terms and conditions of carriage also apply to code share services on flights operated by other carriers.

In the event that the flight is operated by another carrier, you should familiarize yourself with the specifics of the carrier operating the flight, such as check-in times, requirements for booking reconfirmation, requirements and guidelines regarding the transportation of unaccompanied minors, the transportation of animals, refusal of carriage, oxygen devices, operational irregularities, compensation for refusal of carriage and baggage allowances/receipt, etc.

General information
3.1.
3.1.1. We will only provide transportation to the passenger named on the ticket if a confirmed booking exists. We reserve the right to refuse carriage if the passenger cannot prove his/her identity.
3.1.2. Tickets are not transferable.
3.1.3. The conditions for ticket refunds are subject to the applicable fare conditions in effect at the time the ticket was issued. You should choose the airfare that best suits your needs. It may be advisable to take out travel cancelation insurance.

Validity period
3.2.
3.2.1 Unless otherwise specified on the ticket, in these terms and conditions, or in applicable fares (which may limit the period of validity of the ticket as specified on the ticket), a ticket is valid as per the following:
3.2.1.1 for one year, calculated from the date of issue or
3.2.1.2 for one year from the time the trip is planned to start, provided that this takes place within one year from the time that the ticket is issued.

Changes at the passenger’s request
3.3.
(3.3.1. and 3.3.2. are omitted)
3.3.3. If you have selected a fare that requires compliance with a fixed series of coupons, but you do not take carriage for all segments or in the order of the individual segments shown in the ticket, with otherwise unchanged travel dates, and a higher airfare would have been payable on the day of booking for your altered routing, we will collect this price difference, taking into account the airfare already paid. We will then calculate the airfare that you would have had to pay in your price group on the day of your booking for your actual itinerary. If the price group you originally booked was not available for the altered routing on the day of the reservation, the lowest available price group for your altered routing will be used for the subsequent fare calculation. Please note that we may make carriage dependent on your having paid the difference.
If you have a refundable ticket in accordance with the fare conditions and have not yet used any part of the journey, you are free to have the ticket price refunded according to the fare conditions. You will then lose your claim to be transported.
For carriage of consumers with habitual residence in Germany or consumers whose place of departure or destination, as stated in the booking, is in Germany, as well as for carriage of consumers resident in Austria, Article 3.3.4 or Article 3.3.5 applies.
3.3.4. For carriage of consumers with habitual residence in Germany or consumers whose place of departure or destination, as stated in the booking, is in Germany, the following applies:
If you have selected a fare that requires compliance with a fixed series of coupons, but you do not take carriage for all segments or in the order of the individual segments shown in the ticket, with otherwise unchanged travel dates, we will subsequently charge any potential price difference between the fare for your altered routing and the fare you already paid, pursuant to Article 3.3.3. This does not apply if, due to force majeure, illness or other reasons that do not become apparent until after booking and that require a deviation from the coupon order or make it reasonable, you are prevented from starting the trip in all segments or in the sequence of the individual segments specified in the ticket. You are then obliged to inform us of these reasons immediately after becoming aware of them and to prove that, at the time of booking, you intended to take carriage for all segments or in the order of the individual segments specified in the ticket and that the use of individual segments is based on circumstances that only became apparent after booking and that require a deviation from the coupon order or make it reasonable. If you are unable to provide proof before commencement of carriage, you must pay any difference to the higher airfare determined in accordance with Article 3.3.3 before carriage. If we do not receive the corresponding payment, we will invoice you for the difference after carriage. For this purpose, you must provide us with your address prior to transportation and prove that it is correct (e.g., by presenting an official ID) so that we can subsequently claim the difference. Please note that we may make transportation conditional upon a) receiving payment for the price difference before transportation or b) you providing us with your address prior to transportation and proving that it is correct. The subsequent calculation of the difference will not take place if you provide proof of the reasons for the deviation from the coupon sequence immediately after carriage. In this case, we will also reimburse you for any additional payment of the difference that you have already made. 3.3.5. The following applies to the transportation of users residing in Austria:
If you have selected a fare that requires compliance with a fixed series of coupons, but you do not take carriage for all segments or in the order of the individual segments shown in the ticket, with otherwise unchanged travel dates, we will subsequently charge any potential price difference between the fare for your altered routing and the fare you already paid, pursuant to Article 3.3.3. This does not apply if your travel plans are simply changing or if due to force majeure, illness or for another reason for which you are not responsible, you are prevented from starting the trip at all or in the sequence of the individual routes specified in the ticket. If possible, please inform us of the reasons for this immediately after becoming aware of them.

Contractual penalty in the event of an unauthorized change of travel class
3.4. Tickets entitle the holder only to carriage in the travel class specified therein. A change to a higher travel class at the request of the passenger constitutes an amendment to the contract and requires our express consent. If we give our consent, it is subject to the condition that the fare difference is paid in full before the commencement of carriage. An unauthorized change to a higher travel class is prohibited, and the passenger's refusal to take the assigned seat constitutes a breach of contractual duty that entitles us to refuse to transport the passenger. If refusal of carriage is not possible or not reasonable for us at the time of the breach of contractual duty, a contractual penalty shall be due for the breach of contractual duty. The debtor of the contractual penalty is the person who booked the flight. In the event of a booking for third parties, the person making the booking must be held responsible for the third party's conduct in breach of duty. The amount of the contractual penalty shall be equal to the fare difference between the total price paid for the carriage and the total price that would have to be paid at least on the day of carriage for carriage in the higher travel class that was chosen without authorization, plus a surcharge of 50% of the fare difference. In addition, we may refuse onward carriage of the passenger.

Misused bookings
3.5.
3.5.1 A booking is misused if, at the time of booking, the passenger has no serious intention of using the carriage guaranteed in the ticket or of being available for it, but makes the booking solely in anticipation of denied boarding, cancellation or major delay within the meaning of Articles 4 to 6 of Regulation (EC) No. 261/2004, in order to obtain a claim for compensation in accordance with Article 7 of Regulation (EC) No. 261/2004.
3.5.2 If there are objectively recognizable indications of misconduct within the meaning of Clause 3.5.1, such as systematic or repeated bookings without actually commencing the journey, we are entitled to take appropriate measures. In particular, we may in this case cancel the affected booking, deny the passenger carriage or bar the passenger from future bookings. We will inform the passenger of such measures and their reasons.
3.5.3 In cases of demonstrable misuse, within the meaning of Clause 3.5.1, we reserve the right to refuse payment of compensation in accordance with Article 7 of Regulation (EC) No. 261/2004. This applies exclusively to such cases of misuse and does not constitute a blanket exclusion of statutory passenger rights. Each individual case is reviewed in compliance with the applicable legal provisions.

Final price
4.1. The final price is the airfare including taxes, fees and charges.

Airfares
4.2. The airfare due shall be the price for transportation from the actual place of departure to the actual place of destination. The airfare may include charges levied by the airline.

Taxes, fees and charges
4.3. All taxes, fees or other charges levied by government, municipal or other authorities or the airport company in relation to passengers or their use of services will be payable by you in addition to the airfares. Upon purchase of the ticket, you will be informed of any such taxes, fees and other charges not included in the airfare. These are usually shown separately on the ticket.

Prerequisites for seat reservations
5.1.
5.1.1. Each coupon is accepted for transportation only in the travel class specified therein for the day and flight for which a seat reservation has been made. For tickets without a registered seat reservation, a seat can be booked later if still available on the desired flight.
5.1.2. We or our agents will record your booking(s). Upon request, we will send you a written booking confirmation.
5.1.3. Certain fares are subject to restrictive terms and conditions regarding rebooking or cancellation.

Personal data
5.3. We process your personal data in accordance with all relevant data protection regulations and only for the following purposes: making flight bookings, purchasing tickets, purchasing additional services, refunding and rebooking tickets and additional services, developing and offering services, carrying out immigration formalities and transmitting such data to the relevant authorities and other airlines or other providers of the aforementioned services in connection with the execution of your trip.

Advance seat reservation
5.4.
5.4.1. On some Discover Airlines flights, you have the option of advance seat reservation. As part of this service, you can select a specific seating category (aisle, window or middle seat, seat with more legroom) if available. Depending on the type of seat, this service is subject to a fee for some fares. The price may vary based on seating category, time and type of booking, flight and route. There is no obligation to make a (paid) advance seat reservation. See the advance seat reservationThe link will be opened in a new browser tab page for details.
5.4.2. If you choose not to make an advance seat reservation for a fee, you will be assigned a seat free of charge at check-in. Changes to an already selected or assigned seat may be subject to payment depending on the fare selected. If you use the “Automatic Check-in” service, you can then select a seat other than the one assigned to you, for which a fee may be charged depending on the fare, provided that other seats are available to you. However, we cannot guarantee specific seats or the availability of a specific seating category.
5.4.3. If you rebook your flight, your existing advance seat reservation will be forfeited and you may make a new advance seat reservation, which may result in a higher cost depending on the fare, seating category, time of rebooking and route.
5.4.4 We are entitled to reassign seats at any time, even after you board the aircraft. This may be necessary for safety or operational reasons. If you have paid for a prior seat reservation and the flight is canceled or if the seat is reassigned for safety or operational reasons, we will refund the advance seat reservation fee. No refund will be made if you choose not to take the flight, if you rebook or upgrade to another travel class or if you have given us incorrect information about your eligibility to sit at the emergency exit at the time of booking.

6.1. Check-in deadlines vary at different airports. We recommend that you look up these check-in deadlines and comply with them. If you do not comply with these times, we are entitled to cancel your booking. We or the travel agency issuing the flight ticket will inform you about the check-in deadline for the first leg of your journey with us. You can find the check-in deadlines for our flights on our website and can obtain them from the travel agency issuing the ticket. Unless otherwise stated, you will need to present yourself for check-in at least 45 minutes before the scheduled departure.
6.2. You are obligated to arrive at the gate for boarding no later than the time specified at check-in.
6.3. If you do not present yourself in time for boarding, we are entitled to cancel your booking.

Right to refuse carriage
7.1. We may refuse your carriage if we have notified you in writing prior to booking within the scope of our due discretion that we will no longer carry you on our flights from the date of the written notification. This may be the case if you have breached the rules of conduct mentioned in Articles 7 and 10 on an earlier flight and your carriage is therefore unreasonable. We may also refuse your carriage if:
7.1.1 this measure is necessary for reasons of safety or order, or to avoid a breach of administrative or legal requirements of the country from which the flight departs, or that is being flown to or over; or
7.1.2. your carriage may impair the health, safety, or to a significant extent the well-being of other passengers; or
7.1.3. your behavior, condition or mental state, e.g. due to the effects of alcohol consumption or drug use, causes you to expose yourself, other passengers or crew members to a hazard; or
7.1.4. you have behaved on a previous flight in such a manner as to significantly breach our rules of conduct, and we have reason to believe that this behavior could be repeated; or
7.1.5. you have refused to undergo a security check; or
7.1.6. you have not paid the applicable final price; or
7.1.7. you do not have the travel documents required for entry to the destination or refuse to show them to the crew despite being asked to do so; or
7.1.8. you present a ticket that you have purchased or received illegally or in breach of the Miles & More terms and conditions of participation or that has been reported as lost or stolen, is falsified, or if you cannot prove your identity as the person registered as a passenger on the ticket; or
7.1.9. you do not comply with our safety regulations; or
7.1.10. you disregard the smoking ban in force on board all of our aircraft or the ban on the use of electronic devices on board.

Transporting children
7.2.
7.2.1. Under the age of 5, children may only travel if they are accompanied by an adult who is at least 18 years of age. Transporting children traveling alone from ages 5 to 12 must be registered by telephone via the Discover Airlines Service Center in advance and is subject to the respective published fee and the published regulations applicable to it.
7.2.2. Children may also travel in their own child seat secured to a seat; for infants under two years of age, you need to take the booking of an additional seat into consideration. You must keep the child seat firmly in place during the entire flight using the seat belt provided on the aircraft seat. The child seat must be suitable and approved for use on board aircraft. Otherwise, we are entitled to refuse carriage of the child seat in the cabin. We are not liable for any consequences resulting from improper securing of the child seat, malfunction, or failure to follow instructions.

Free baggage and excess baggage
8.1. Baggage allowances are based on the published fares in effect at the time of your flight booking. The transportation of baggage above the free baggage limit and the transportation of special baggage are subject to a surcharge. The weight of a single item of baggage may not exceed 32 kilograms.

Baggage from strangers
8.2. Carrying baggage received from strangers, both in carry-on baggage and checked baggage, is not permitted on our flights.

Items unable to be accepted as baggage
8.3.
8.3.1. Items that may not be checked as baggage or included in your baggage:
8.3.1.1. Items that are capable of endangering the aircraft or persons or items on board the aircraft as listed in the ICAO (International Civil Aviation Organization) Dangerous Goods Regulations, the IATA (International Air Transport Association) "Technical Instructions for the Safe Transport of Dangerous Goods by Air" and our transportation regulations (you can obtain more information on request and on our website Dangerous GoodsThe link will be opened in a new browser tab).
8.3.1.2. Items where transporting them is prohibited by the applicable laws and regulations of the country from where the flight departs, flies to or over;
8.3.1.3. Items that are dangerous, unsafe or unsuitable for transportation because of their weight, size, shape, composition or particular sensitivity (you can obtain information about items not suitable for transportation on request or on our website Dangerous GoodsThe link will be opened in a new browser tab).
8.3.2. Weapons of war are excluded from transport as baggage. Only sporting, hunting and service weapons, as well as ammunition of hazard subclass 1.4S with UN0012 or UN0014, may be transported as checked baggage in accordance with our conditions. Each weapon must be secured, unloaded and packaged in a sealed, sturdy and safe carriage container provided for this purpose, e.g., made of wood, metal, hard-shell material or Styrofoam and suitably packaged. The carriage of ammunition is subject to the ICAO and IATA dangerous goods regulations, as described in Article 8.3.1.1. You must present both firearms and ammunition for inspection prior to acceptance.
8.3.3 Blunt instruments and weapons such as antique firearms, swords, knives or similar items are permitted in checked baggage at our discretion, but may not be taken into the aircraft cabin. Items used for self-defense, such as numbing devices, shock devices and incapacitating chemicals or substances such as "knock-out drops," irritant gas, pepper sprays, capsicum sprays, tear gas, acid sprays and animal defense sprays are excluded from carriage as baggage.
8.3.4. If, despite the above prohibitions, items listed in 8.3.1, 8.3.2, and 8.3.3 are included in your baggage, we will not be liable for the loss or damage of these items.
8.3.5. You may not carry any money, medication, keys, jewelry, precious metals, negotiable papers, securities, or other valuables, business documents, passports, other identification documents or samples, loose batteries or power banks in your checked baggage. If, despite this prohibition, the items mentioned are included in your checked baggage, we will not be liable for the loss or damage of these items.
8.3.6. We strongly recommend that you do not put computers or other portable electronic devices in your checked baggage. If, despite this prohibition, the items mentioned are included in your checked baggage, we will not be liable for the loss or damage of these items.

Right to refuse the carriage of baggage
8.4.
8.4.1. We may refuse to carry baggage if it is not transported in accordance with paragraph 8.3.
8.4.2. We may refuse to carry baggage if it is unsuitable for carriage due to the size, form, weight, type and content or for safety reasons or with regard to the well-being of other passengers. You can obtain information on items that are not suitable for carriage upon request.
8.4.3. We may refuse to carry baggage if it is not properly packed in suitcases or similar containers in order to ensure safe carriage with the customary care during handling.

Searching of passengers and baggage
8.5. For security reasons, we may request that you consent to a search or screening of yourself and your baggage as well as an X-ray of your baggage. If you do not consent to a search of yourself or your baggage for the presence of prohibited or undeclared items as per paragraph 8.3, we may refuse to allow you to board and to carry your baggage. If you are not present, we may open and search your baggage in your absence and remove any unauthorized or undisclosed items as per paragraph 8.3. We have no obligation to hold any removed items and are not liable for their loss or damage. We will not be liable for damage to your baggage caused by opening it if there were any unauthorized or undisclosed items in your baggage pursuant to paragraph 8.3.

Checked baggage
8.6.
8.6.1. After handing over your baggage at check-in, it will be taken into our keeping, and we issue a baggage receipt and a baggage ticket to identify the baggage.
8.6.2. Checked baggage must be labeled with your name or another means of identification.
8.6.3. Checked baggage will be transported on the same aircraft as you, unless this is not possible for security reasons. If your checked baggage is therefore transported on a subsequent flight, we will deliver it to your location, unless your presence is required for customs inspection. Article 13 (liability for damages) remains unaffected.

Carry-on baggage
8.7.
8.7.1 We specify the number, maximum weights and maximum dimensions for carry-on baggage. In all cases, carry-on baggage must fit under your front seat or into the baggage compartments. If your carry-on baggage does not meet these requirements or does not meet security requirements, it must be transported as checked baggage, and we reserve the right to charge you for this in accordance with the baggage rules applicable to your fare.
8.7.2. Items that are not suitable for carriage in the hold, e.g. fragile musical instruments that do not meet the requirements of paragraph 8.7.1. will only be accepted for carriage in the cabin if you have given us prior notice and we have accepted the item for carriage. We may charge extra for this special service.

Return of checked baggage
8.8.
8.8.1. You are required to collect your baggage as soon as it is available for pick-up at the destination airport or at the stopover location.
8.8.2. We will only hand over checked baggage to the holder of the baggage receipt.
8.8.3. If the person receiving the baggage cannot present the baggage receipt or cannot identify the baggage through the identification part of the baggage ticket, we will only hand over the baggage on condition that the right to collect it is established to our satisfaction.

Transport of animals
8.9.
8.9.1. The transport of pets is subject to our consent and to the conditions that the animals are provided with valid health and vaccination certificates, entry permits and other entry or transit documents required by the respective countries and, if they are not recognized service dogs or assistance animals, are properly enclosed in transport containers or approved travel carriers. We reserve the right to establish the type and manner of carriage and to limit the number of animals permitted on a flight.
Animals traveling in the cabin (including transport containers, if applicable) must fit into the footwell of your seat and be adequately secured during the entire stay on board.

The weight of the animals, transport containers and animal feed carried is not included in the passenger’s free baggage. Excess baggage charges are payable for the transport of animals.
8.9.2. A recognized service dog required for the passenger will be transported in the cabin free of charge and whenever possible; please note the conditions available to view in Transportation of assistance dogsThe link will be opened in a new browser tab for flights outside the United States of America.
8.9.3. On flights to or from the United States of America, Discover Airlines shall guarantee to the extent required by 14 CFR Part 382 and other legal provisions the free transportation of an assistance animal by a person with a disability (as defined in 14 CFR § 382.3), provided that the presence of the assistance animal is required to help the passenger perform tasks or functions for their benefit. Discover Airlines only accepts dogs as assistance animals. A passenger with a disability who travels with an assistance animal assumes full responsibility for the safety, health, well-being and behavior of the assistance animal. This also applies to the interaction of the assistance animal with other passengers and crew members while on board the aircraft or in any airport areas managed by Discover Airlines.
8.9.4. You are solely responsible for the safety, health and conduct of your animal and are responsible for compliance with all entry, exit, health and other regulations and laws as well as requirements applicable in the country, state or territory from which the animal is transported and/or in which an interim destination is located. This applies in particular to all health certificates, approvals and vaccinations required. Discover Airlines is in particular not liable for costs associated with placing the animal in quarantine, as well as fines and costs associated with returning the animal to its place of departure.
You shall be liable for all costs arising from the failure to comply with these obligations as well as laws, regulations and requirements and for any damage caused by animals you have brought with you, and we shall be released from any relevant liability, unless we have caused the damage ourselves through gross negligence or willful misconduct.

General information
9.1.
9.1.1 In the event of cancellation, rebooking or delay, a refund of the airfare may be considered under certain conditions, among other claims.
9.1.2 In addition, refunds are possible in accordance with the fare conditions. Some fares include restrictions regarding refundability.
9.1.3 The refund value of the fare, taxes and fees will be calculated depending on the fare conditions and any segments of the ticket used. We will not reimburse you for any fees incurred when using a particular payment method.

Recipient of the refund
9.2. The refund is generally made via the payment method used for the booking. The payment is considered a refund to the person entitled to a refund.

Currency
9.3. The refund will be made in the same currency in which the airfare was paid. The refund amount may differ from the amount originally paid for the refunded ticket due to conversions and fees from your payment service provider.

Refund at the travel agency
9.4. For tickets booked through a travel agency, the refund value may differ from the amount you paid to the travel agency due to fees charged by the travel agency. We therefore recommend that you contact the travel agency and have the refund processed there.

General information
10.1. You are obliged to follow the crew’s instructions. If your behavior on board poses a danger to the aircraft or to persons or items on board, if you interfere with the crew in the performance of their duties or fail to comply with crew instructions, including those relating to smoking bans, alcohol consumption or drug use, or if you cause inconvenience or harm to other passengers or the crew, we reserve the right to take the necessary measures to prevent such behavior, up to and including restraint. We can refuse your onward carriage and file a criminal complaint for your conduct on board.

Electronic devices
10.2. The use of cell phones, radios and remote-controlled toys is not permitted on board. For mobile phones, an exception applies to aircraft equipped with functional mobile technology. On these aircraft, it is possible to use cell phones as instructed by the crew. Voice telephony is to be prevented in all cases.

Non-smoking flights
10.3. All Discover Airlines flights are non-smoking flights. Smoking is prohibited in all areas of the aircraft. This also applies to electronic cigarettes.

Alcoholic beverages
10.4. It is not permitted to consume alcoholic beverages brought on board.

Obligation to wear seat belts
10.5. You are basically obliged to remain in your seat throughout the flight. When seated, you are obliged to fasten your seatbelt.

Taking photographs and filming on board
10.6. Filming and taking photographs on board is only permitted if it is ensured that the rights — in particular the personal rights — of the persons being recorded are protected. In the event of a breach, filming and photography on board may be prohibited at any time when instructed by the crew.

11.1. If we arrange services other than flight services for you with third parties or issue travel documents for carriage services other than flight services, we are only acting as an agent in this respect. In such cases, the respective service provider’s terms and conditions apply.
11.2. Terms and conditions other than these terms and conditions may apply to shuttle services that we provide ourselves for our passengers and that do not include flight services. They will be sent to you upon request.

General information
12.1.
12.1.1. You are required, and it is your own responsibility, to obtain the necessary travel documents and visas for your trip and to comply with all regulations of the countries you fly over, into or out of, as well as our regulations and instructions in this regard. Your travel documents and visas must be valid for the entire duration of your trip, including any interruptions. We are not responsible in this regard; in particular, we are not obligated to check their validity.
12.1.2. We are not liable for any consequences that may arise for you from the failure to carry the necessary papers with you or from the failure to comply with the applicable regulations or instructions.

Travel documents
12.2. You are obliged to present the entry and exit documents, health certificates and other documents required by the countries in question upon our request and to allow us to make copies of these documents, if necessary, prior to your departure. We reserve the right to exclude you from carriage if you do not comply with the applicable regulations or your documents are incomplete, and we will not be liable for any losses or expenses incurred by you as a result of your failure to comply with these regulations.

Entry ban
12.3. If you are denied entry into a country, you are obligated to pay the applicable airfare if we have to transport you to your departure location or to another location because you are not allowed to enter a country (transit or destination country). We may use the funds you paid for unused carriage to pay this airfare. The airfare paid for carriage to the place of rejection or identification will not be refunded.

Passenger liability for penalties, etc.
12.4. If we are required to pay or lodge penalties or fines or incur other expenses because you have not complied with the applicable regulations of a country as regards entry or transit or because the documents required were not correctly presented, you are obliged to reimburse us on request for the amounts paid or deposited.

Customs checks
12.5. When requested to do so, you must attend the inspection of your checked and unchecked baggage by customs and other officials. We are not liable for any damages incurred by the passenger during the check or as a result of failure to comply with this provision.

Security checks
12.6. You are obliged to submit both yourself and your baggage to the security checks carried out by the authorities, the airport companies or us.

Transmission of data
12.7. We are entitled to transfer your passport details and your personal data processed and used by us in connection with your trip to authorities in Germany and abroad (including authorities in the USA and Canada) if the respective transfer request of the authority is based on legal provisions and is therefore required to fulfill the contract of carriage.

General information
13.1.
13.1.1. Carriage is subject to the liability regulations of the Montreal Convention of March 28, 1999, which was transposed in the European Community by Regulation (EC) No. 2027/97 in the version amended by Regulation (EC) No. 889/2002 as well as by national legislation of the member states.
13.1.2. If the injured party is partly to blame for the damage, the provisions of the applicable national law shall apply with regard to the exclusion or reduction of the obligation to pay compensation in the event of contributory negligence on the part of the injured party.
13.1.3. Any action for damages under the Montreal Convention must be brought within two years, starting from the day the aircraft arrived, the day the aircraft should have arrived or the day the carriage was terminated.
13.1.4. We are not liable for damages arising from our compliance with government regulations or from your failure to comply with the resulting obligations.
13.1.5. Our liability never exceeds the amount of the proven damage. We shall only be liable for indirect or consequential damages if we or our employees have caused them through gross negligence or willful intent. This does not apply to personal injury.
13.1.6. The disclaimers and limitations of liability of the Montreal Convention and the relevant applicable national law shall apply unless expressly provided otherwise in these terms and conditions of carriage.

Compensation in the event of death and bodily injury
13.2.
13.2.1. There is no limit to the maximum liability amounts in the event of death or bodily injury of passengers. For damages up to an amount of SZR 151,880 (approx. EUR 190,000), the air freight carrier may not raise any fault-related objections to claims for damages. Claims in excess of this amount can be averted by the air freight carrier by proving that both it and its employees did not act negligently or otherwise culpably and that no negligent or otherwise culpable omission was the cause.

Advance payments
13.2.2. If a passenger is killed or injured, the air freight carrier must make an advance payment within 15 days of the person entitled to compensation being established in order to cover immediate financial needs. In the event of death, the advance payment will be no less than SZR 16,000 (approx. EUR 19,000).

Destruction, loss or damage of baggage
13.3.
13.3.1. In the case of checked baggage within the meaning of Art. 8.6 of these terms and conditions of carriage, liability exists regardless of fault unless the baggage was already damaged beforehand. For unchecked baggage, we are only liable for our culpable conduct and that of our employees.

Baggage liability limits
13.3.2. We are liable for the destruction, loss or damage of baggage up to an amount of SZR 1,519 (approx. EUR 1,800). A higher liability limit applies if the passenger, at the latest at check-in, makes a special declaration of the amount-related interest in delivery of the checked baggage at the destination and pays the requested surcharge. In this case, the agreed amount shall be deemed to be the limit of liability unless the air freight carrier can prove that the agreed amount is higher than the passenger's actual interest in delivery of the checked baggage at the destination.

Baggage complaints
13.3.3. If you accept the checked baggage without reservation, it is assumed until the contrary is proven that it has been delivered in good condition and in accordance with the contract of carriage. In the event of damage, loss or destruction of baggage, you must notify the air freight carrier as soon as possible in writing or in text form. In the event of damage to baggage, any claim is excluded if the entitled party does not notify the air freight carrier immediately after discovery of the damage, but in the event of checked baggage in any case no later than seven days after acceptance of the baggage. This does not apply if the air freight carrier has acted fraudulently.
13.3.4. We shall not be liable for damages caused by items in your baggage, unless we have caused them through gross negligence or willful intent. If these items cause damage to the baggage of another passenger or our property, you must compensate us for all damages and expenses arising from this.

Delay in the carriage of passengers and baggage
13.4.
13.4.1. We shall be liable for damages caused by delays in the carriage of passengers and the carriage of checked baggage, unless we and our employees have taken all reasonable measures to avoid damages or if it was impossible for us or our employees to take these measures.

Liability limits for damage due to delay
13.4.2. Liability for damages caused by delays in the carriage of passengers is limited to SZR 6,303 (approx. EUR 7,800).
13.4.3. Liability for damage caused by delays in the transport of baggage is limited to SZR 1,519 (approx. EUR 1,800). A higher liability limit applies if the passenger, at the latest at check-in, makes a special declaration of the amount-related interest in delivery of the checked baggage at the destination and pays the requested surcharge. In this case, the agreed amount shall be deemed to be the limit of liability unless the air freight carrier can prove that the agreed amount is higher than the passenger's actual interest in the delivery of the checked baggage at the destination.

Baggage complaints
13.4.4. In the event of damage caused by the delayed delivery of baggage, the passenger must notify the air freight carrier in writing or in text form as soon as possible. In the event of damage caused by delay, any claim is excluded if the entitled party does not report the damage within 21 days after delivery of the baggage at the latest. This does not apply if the air freight carrier has acted fraudulently.

Contributory negligence of the passenger
13.4.5. If the injured party is partly to blame for the damage, the amount of the claim for damages shall be reduced proportionally to the contributory negligence of the injured party. In particular, the injured party is obligated not to increase the damage caused by baggage loss or the delayed transport of baggage by making inappropriate replacement purchases.

The headings in these terms and conditions of carriage are for convenience only and are not relevant to their interpretation and construction.

Carriage is subject to other rules and conditions that apply to or have been issued by us. These regulations and conditions may be subject to change.
